Handover is disputed: which final-pay items should be recorded separately?

Start with the payment categories
Shanghai’s wage-payment rule effective from 1 August 2026 says final wages must be paid in one sum when departure procedures are completed, with a special lawful agreement possible in specified circumstances. This is the Shanghai local rule, not a nationwide grace period. Article 50 of the national Labour Contract Law separately links applicable economic compensation to completed handover. Wages and compensation must not be treated as one payment category.
Create a wage ledger to the last day
List ordinary pay periods, unpaid worked time, approved leave, bonus conditions, expenses and payments already received. Ask for the final statement and relevant payday. Mark uncertain items rather than including them as guaranteed income. Keep calculation evidence such as your own payslips and lawfully retained work records, without taking confidential customer material.
Use a separate handover receipt
List equipment, accounts and tasks with a responsible recipient and return date. Ask for acknowledgement and identify any disputed item. If the employer alleges a loss, request the facts, amount and basis separately from the wage statement. Do not sign a broad admission of damage merely to obtain confirmation that a laptop was returned.
Turn the dispute into specific questions
Ask which payment is withheld, the reason, applicable clause and proposed resolution date. Seek local advice about the wage and compensation routes if they remain disputed. Return property through the agreed safe process while keeping the financial questions recorded. The mere existence of a dispute neither fixes the amount owed nor proves that a deduction is lawful.
Illustration: separating the three questions
Suppose a Shanghai employee resigns, returns a company laptop, and the employer says the final wage will be paid only after the employee signs a statement admitting a shortfall in the cash drawer. The employee should ask: 'Which item is the wage, which is the disputed loss, and which is the property return?' The wage ledger covers the last pay period; the handover receipt records the laptop return; the loss claim must be supported by facts and amount. The employee can ask: 'If I sign the handover receipt for the laptop, does that also admit the cash shortage?'
Next steps if unresolved
If the employer withholds a specific wage item, ask for the written reason and the applicable clause. If the dispute concerns economic compensation, check the handover completion condition under national law. For local advice, bring the wage ledger, handover receipt, and any written loss claim to a labour law advisor. Do not agree to a total amount until each category is separately recorded.
