Certificate and handover duties are distinct

Shanghai HRSS’s published analysis explains that issuing the termination certificate is a statutory employer duty and cannot be made conditional on a handover dispute. It also distinguishes requesting the document from claiming financial loss. That historical matter does not establish a fixed compensation amount for everyone whose certificate is delayed.

Make a traceable document request

Make a dated request identifying the legal employer, employment dates and certificate needed. Attach the end-of-employment notice or agreement where useful, and state any disputed date accurately. Ask for the document and a delivery method, rather than combining the request with every wage dispute. Preserve the message, delivery evidence and reply. An identifiable request makes it easier to establish what you asked for and why a delay matters.

Record the practical effect of the delay

If a new employer or benefit process requires the certificate, keep its written request and any deadline. Record the response to a possible alternative document. Save evidence of a lost opportunity or cost without assuming that your former monthly wage is automatically the measure of loss. The causal link and available remedy need assessment.

Use the appropriate correction route

Ask the local human-resources authority about obtaining the document and an adviser about any separate loss claim and time limits. Continue to address genuine handover tasks through a safe process. Keep those communications separate so that requesting a certificate is not confused with admitting an unrelated allegation about property or confidential information.

Example: a new employer requests the certificate

Hypothetical illustration: a new employer requests a termination certificate before completing onboarding. The former employer replies that a laptop-handover disagreement remains. Keep both messages and ask the former employer to supply the certificate while addressing the laptop issue separately. Ask the new employer whether the termination notice can temporarily meet its documentary requirement. This records the practical obstacle without treating the historical Shanghai case as an automatic damages award.

Prepare a document request and a loss claim separately

For obtaining the certificate, bring the employment-ending record and your traceable requests. For a loss claim, also gather the new employer’s requirement, the relevant dates, any alternative offered and evidence of actual lost income or costs. Ask what route and time limit apply to each issue and what causal link must be shown. Continue genuine handover work through a documented process; obtaining a certificate need not mean admitting an unrelated property allegation.
