Canada: My ROE is missing or says I quit — can I apply for EI?

Workplace scenario

Scenario scope:Canada · federal EI and Record of Employment rulesLaw checked and verified:2026-10-14

Apply for EI without waiting for an ROE. Service Canada decides eligibility from the facts, and you can ask it to obtain or investigate a missing or incorrect record.

Scenario

Your shifts stop because business is slow, but payroll does not issue an ROE. When one finally appears online, it says you quit. You have messages showing the employer ended the work and need income while the record is corrected.

What the law says

Yes: you can apply for EI before the ROE arrives, and a quit code does not by itself decide eligibility. Service Canada examines the actual separation and other eligibility conditions. For weekly, biweekly or twice-monthly payroll, an electronic ROE is due within five calendar days after the affected pay period ends. For monthly or 13-period payroll, use the earlier of that date and 15 calendar days after the interruption begins. Paper ROEs are due within five calendar days of the interruption’s first day or when the employer becomes aware. An electronic ROE goes to Service Canada; the employer need not give you a paper copy.

What you can claim

If eligible, EI regular benefits are generally 55% of average insurable weekly earnings calculated from the required best weeks, up to C$729 per week in 2026. Request an accurate ROE and correction of the separation reason so Service Canada can assess benefits owed. A late or inaccurate ROE does not itself guarantee EI, a particular benefit duration or compensation from the employer.

What the employee can do

  1. Apply for EI through Service Canada promptly without waiting for the ROE. Applying more than four weeks after your last workday can cost benefits. Prepare your SIN, employment dates, employer details, pay records and separation messages.

  2. Ask payroll in writing for the pay-period type, ROE filing date and correction of the disputed reason. Check My Service Canada Account; if the record remains missing or inaccurate, ask Service Canada to obtain or investigate it and provide the dismissal messages.

  3. If benefits are refused, submit a signed EI reconsideration request to Service Canada in person or by mail within 30 days after the decision was communicated. Include the decision and your evidence of the actual separation; chasing payroll alone does not meet that deadline.

Common misconception, corrected

You can apply before the ROE arrives. That does not guarantee benefits or make every resignation eligible; Service Canada examines the actual circumstances.
