UK: My approved holiday was cancelled after I booked travel — can I challenge it?

Workplace scenario

Scenario scope:United Kingdom · England and Wales · statutory annual leaveLaw checked and verified:2026-10-14

An employer can cancel approved holiday only with the applicable notice and must allow statutory leave. Travel refunds depend on a separate contractual promise or claim, not automatic holiday compensation.

Scenario

You booked travel after written approval for a week off. Shortly before departure, your employer cancels the holiday because staffing is short. Your bookings are non-refundable and you need to know whether you can insist on leave or recover costs.

What the law says

You can challenge a cancellation that fails the applicable notice rule, but approval does not make leave impossible to cancel. Under the default rule, GOV.UK describes the employer’s cancellation notice as the amount of leave requested plus one day; a relevant agreement can vary this. The employer must still allow statutory leave to be taken. Cancellation does not automatically create a right to ignore an attendance instruction or recover travel costs; a separate contract or policy must be assessed.

What you can claim

Request restoration of leave where notice is insufficient, or alternative dates that let you use your statutory entitlement: generally 5.6 weeks a year, equivalent to 28 days for a five-day week. For five days of requested leave, GOV.UK’s default cancellation guidance requires six days’ notice; check the agreement and exact start date.

If statutory leave is unlawfully refused, a Working Time Regulations claim can seek a declaration and compensation the tribunal considers just and equitable, rather than a fixed penalty. Claim documented non-refundable travel losses only where a separate enforceable promise or legal basis supports them, less refunds or avoidable losses.

What the employee can do

  1. Send HR the approval, cancellation time, leave dates, contract or holiday policy and booking receipts. Ask which notice provision permits cancellation and whether your original dates can be kept.

  2. Request alternative dates and reimbursement under any relevant promise or policy. Contact Acas or an adviser if the leave right is still refused. Seek advice before travelling against instructions or resigning, and seek refunds to limit avoidable losses.

  3. A tribunal claim about refusal of statutory leave usually runs from when the leave should have begun, which can differ from the cancellation date. The usual initial limit is three months less one day if that relevant date is before 1 October 2026, or six months less one day on or after it. Notify Acas in time; internal grievances do not pause it. A separate travel-cost contract claim may require civil court and has its own deadline.

Common misconception, corrected

A staffing problem does not remove the applicable notice requirement. Buying tickets does not create an automatic right to ignore cancellation or recover every expense.
